These Terms & Conditions (“Terms”) govern your access to and use of the Kio Tutor mobile application (“App”) and related services (“Services”). By using the App, you agree to these Terms. If you do not agree, do not use the App. The App is currently intended for users located in India.

1. About Kio Tutor

Kio Tutor provides English learning features including reading practice, vocabulary/dictionary features, speaking practice, and other learning tools. Some features may use cloud services for AI responses, translation, or voice generation.

2. Eligibility & Account Registration

You agree to provide accurate information during registration and keep it up to date. You are responsible for maintaining the confidentiality of your account and for all activities under your account. Your use of the Services is also governed by our Privacy Policy, available at privacy.html. If you suspect unauthorized use, contact support@kiotutor.com.

3. OTP, Password Reset & Security

We may require email OTP verification for login or password reset. You must not share OTP codes with anyone. Kio Tutor staff will never ask you for your OTP or password.

4. Single-Device Session Policy

For security and abuse prevention, we may enforce a single-device session policy for your account. If your account is active on another device, you may be blocked from simultaneous access or asked to re-verify.

5. Subscriptions, Trials & Access

The App may offer free trials and paid subscription plans (for example, Basic and Unlimited). Trial eligibility may be device-bound to prevent misuse. Subscription access is time-based and may expire automatically at the end of the subscription period. Plan features and pricing may change over time; we will show the current offer and details in the App at the time of purchase.

6. Payments

Payments for subscriptions may be processed by third-party payment providers (for example, Razorpay). We do not store your card number, CVV, net-banking credentials, or UPI PIN. Payment verification may use signatures/webhooks and security checks to prevent fraud.

7. Refunds

Refunds (if any) are governed by our Refund Policy. Please refer to Refund for details.

8. Referral & Commission Program

The App may provide referral and commission features. Eligibility, status, and redemption depend on program rules shown in the App. We may verify transactions before confirming commission. We reserve the right to hold, reverse, cancel, or suspend referral benefits if we detect misuse, fraud, chargebacks, policy violations, or suspicious activity.

If you provide a UPI ID, it is used only for referral commission payout (where applicable).

9. AI / Voice / Translation Features (Important Notice)

Some features may use cloud services such as Google Cloud Vertex AI (Gemini), Text-to-Speech, and Translation APIs to generate learning responses.

By submitting text (for example, chat prompts, translation inputs, vocabulary queries, or practice answers), you grant Kio Tutor a limited, non-exclusive right to process, store, and use such content for providing and improving the Services.

Generated outputs (including explanations, translations, answers, and voice responses) may be stored in our systems in a generalized and anonymized form to enhance performance, reduce repeated processing, and improve user experience.

AI-generated responses may be inaccurate, incomplete, or contextually imperfect. You are responsible for how you use learning outputs and should not rely on the App for professional advice (medical, legal, financial, etc.).

10. Acceptable Use & Prohibited Activities

You agree not to:
• Attempt unauthorized access or bypass security controls (including session/device rules)
• Manipulate payments, orders, webhooks, or referral records
• Abuse trials, create fraudulent accounts, or use the Services for unlawful purposes
• Reverse engineer, copy, or redistribute proprietary App content without permission
• Upload or submit content that is illegal, harmful, or infringes the rights of others

11. Intellectual Property

The App, its content (excluding user content), branding, logos, design, and materials are owned by Kio Tutor or its licensors and are protected by applicable laws. Except as permitted by law, you may not copy, modify, distribute, sell, or create derivative works from the App or its content without prior written permission.

12. Service Availability & Changes

We may update, modify, suspend, or discontinue any part of the Services at any time (including features and pricing). We may perform maintenance that affects availability. We do not guarantee uninterrupted access.

13. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Kio Tutor will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits/data, arising from or related to your use of the App, including issues caused by network failures, third-party service outages (payment/email/cloud), or unauthorized access despite reasonable safeguards.

15. Termination

We may suspend or terminate your access if we reasonably believe you have violated these Terms, engaged in fraud, abused the referral program, or caused harm to the platform or other users. You may stop using the App at any time.

16. Governing Law & Jurisdiction (India)

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of courts in Katihar, Bihar, India.

17. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on this page with a new “Last Updated” date. Continued use of the App after changes means you accept the updated Terms.
